Cannabis Club Law

Cannabis Club Law - Legal Counsel for Cannabis Associations in Barcelona

Cannabis Club Law is a specialist practice focused on the legal framework that governs cannabis social clubs and private associations in Catalonia. We advise founders, boards, members and third parties who need to understand where the lines are drawn and how to stay on the right side of them. The regulatory environment around cannabis associations in Barcelona has always been complex. In 2026 it is more complex than ever. New municipal ordinances, tighter enforcement, ongoing tension between local, regional and national authorities, and a body of case law that continues to shift. This is the ground we work on every day.

What We Do

We provide legal analysis, structural advice and representation to cannabis associations operating under Organic Law 1/2002 on the right of association, within the constraints set by Organic Law 4/2015 on citizen security and the national criminal framework. Our work covers the full life of an association, from the drafting of statutes through day to day compliance, inspections, sanctions and, where necessary, judicial defence.

We do not represent commercial cannabis businesses, we do not act for street operators, and we do not take instructions from anyone acting outside the associative model. Our practice is limited to properly constituted non profit associations and the individuals lawfully connected to them.

Why This Practice Area Requires a Specialist

Cannabis association law sits at the intersection of constitutional law, administrative law, criminal law and municipal regulation. General practitioners can and do get it wrong. Court rulings from the Tribunal Constitucional and the Tribunal Superior de Justicia de Catalunya have repeatedly reshaped the ground rules, most notably with the annulment of Catalonia's Law 13/2017 through STC 100/2018. Municipal ordinances add another layer, and enforcement patterns vary from one district to another.

A specialist practice reads this environment continuously. We do not treat cannabis association work as a side matter. It is the centre of what we do.

Our Approach

Our Approach

Discretion, precision and honesty. We tell clients what the law actually says, what the courts are actually doing, and what the realistic exposure looks like. We do not oversell certainty in an area of law where certainty is rarely available. We do not encourage litigation for its own sake. We keep our advice grounded, our communications private and our client relationships long.

Who We Work With

Founders and boards of new and established associations. Members facing personal exposure following inspections or interventions. Landlords and lessors of properties used by associations. Auditors, accountants and other professionals whose work touches on the associative sector. Foreign counsel needing local support on a Spanish or Catalan matter.

We do not represent the general public and we do not offer information services to walk in enquirers looking for a club to join. That is not the work we do.
